Overview of Malpractice Actions Against Child Welfare Agencies or Caseworkers

There are major problems with respect to the way in which child welfare agencies and caseworkers operate in the child welfare system. The agency or caseworker may neglect the child, not provide adequate avenues for the child, or may even in extreme cases lose the child in the welfare system. There has been a large increase of malpractice actions filed by children and their parents against both agencies and caseworkers.

Overview of the Family Medical Leave Act

The Family Medical Leave Act (FMLA) is a federal law that provides certain employees with up to 12 weeks of unpaid and job-protected leave from her employment. The FMLA applies to all public and private employers that have 50 or more employees within a 75-mile radius of one another.

Partial Birth Abortion Ban Act of 2003

In 2003, the Partial Birth Abortion Ban Act was enacted. The Act authorizes fines and/or jail terms of up to two years for any doctor who performs a partial birth abortion. A partial birth abortion is defined as an abortion in which the baby is delivered past the baby’s navel outside the body of the mother or after the entire fetal head is outside the body of the mother. Most partial birth abortions are performed between 20 and 26 weeks.
